1. Acceptance of These Terms

By accessing or using ClanCharts.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and ADONE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (“ClanCharts”, “we”, “us”, “our”), a company incorporated in Poland.

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.


2. About ClanCharts

ClanCharts provides a web-based tool that:

  1. Accepts family tree data files in GEDCOM format exported from genealogy services such as Ancestry, MyHeritage, or FamilySearch
  2. Generates artistic family tree visualisations from those files
  3. Allows you to customise the visual output (layout, generations, title, style)
  4. Offers high-quality digital files for download and professional canvas prints for order

The Service is provided as an internet-based software service. No software installation is required.


3. Eligibility

You must be at least 18 years old to create an account or make a purchase. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into a binding contract in your jurisdiction.

Guest use (uploading a GEDCOM file and viewing a preview without creating an account) is available without age verification; however, purchase requires an account and agreement to these Terms.


4. Your Account

4.1 Registration

You may register an account using your email address and a password, or (if offered) through a supported authentication method. You agree to provide accurate and complete information during registration and to keep it current.

4.2 Account security

You are responsible for maintaining the confidentiality of your login credentials. You agree to:

  • Use a strong, unique password
  • Not share your credentials with others
  • Notify us immediately at support@clancharts.com if you believe your account has been compromised

We are not liable for any loss resulting from unauthorised use of your account due to your failure to maintain credential security.

4.3 One account per person

Accounts are for individual use. Creating multiple accounts to circumvent limitations, refund policies, or access controls is prohibited.

4.4 Account deletion

You may delete your account at any time via account settings or by contacting support@clancharts.com. Upon deletion, your files and personal data are handled as described in our Privacy Policy.


5. Family Tree Files (GEDCOM) — Your Responsibilities

This section is important. Please read it carefully.

5.1 You are responsible for your file

When you upload a GEDCOM file to ClanCharts, you are responsible for that file and its contents. By uploading a file, you represent and warrant that:

  1. You assembled or obtained the file for your own personal genealogical research or family history purposes
  2. Where the file contains personal data of living individuals (family members), you have a lawful basis to upload and process their data — for example, because they are members of your immediate household, you are their parent or guardian, or you have their permission
  3. Where the file incidentally contains sensitive personal information (special category data under Art. 9 GDPR/UK GDPR), such as health data, religious beliefs, or ethnic or national origin, you have a lawful basis to upload and process such information as well
  4. You have the right to submit the file and to use ClanCharts to generate a visualisation from it
  5. The file does not contain data obtained unlawfully (for example, by unauthorised access to another person’s account on a genealogy platform, by deception, or otherwise in violation of applicable law)

You confirm these representations by checking the required declaration checkbox before uploading. If any of the above representations are inaccurate, legal responsibility for any resulting data protection breach rests entirely with you.

5.2 Data of living relatives

We recognise that family tree files commonly include data about living people who did not upload the file. We process those files under the lawful basis of our legitimate interest in providing the visualisation service you have requested, without indexing or using the underlying genealogical records for any other purpose.

By agreeing to these Terms, you acknowledge that:

  • You bear primary responsibility as the person who chose to upload the file
  • You will not upload files containing data of living individuals where doing so would violate applicable data protection law or those individuals’ reasonable privacy expectations
  • If a living individual whose data appears in a file you uploaded submits a valid data protection request to us (for example, a request for erasure under Art. 17 GDPR), we may be required to delete the entire uploaded GEDCOM file. In that event:
    • The file will be removed from the service immediately and will no longer be accessible to you
    • We will send you a notification to the email address registered on your account
    • You may request a copy of your file within 14 days of that notification, before the file is permanently removed from our backup systems
    • The file will be permanently deleted from all our systems within 30 days of the third-party request

You accept this as a condition of uploading files containing personal data of third parties. We recommend keeping a local copy of any GEDCOM file you upload.

5.3 No unlawful or harmful content

You agree not to upload GEDCOM files that:

  • Were obtained by hacking, unauthorised access, or deception
  • Contain data you know to be fabricated or fraudulently attributed to real people
  • Are intended to harass, expose, or harm individuals named in the file

5.4 ClanCharts’ role

We provide the technical platform for visualisation. We are not the originator of the genealogical data, and we do not independently verify its accuracy. We are not responsible for errors, inaccuracies, or privacy implications of the data in files you upload.


6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service in any way that violates applicable local, national, or international law or regulation
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Scrape, crawl, or systematically extract data from the Service by automated means
  • Attempt to gain unauthorised access to any part of the Service, its servers, or related systems
  • Upload files containing malware, viruses, or any other harmful code
  • Use the Service to generate content that infringes a third party’s intellectual property rights
  • Impersonate another person or entity
  • Create accounts by automated means or under false pretences
  • Resell, sublicence, or commercially exploit the Service or its outputs without our written permission

We reserve the right to suspend or terminate your account for violation of these rules (see Section 17).


7. Orders and Payment

7.1 How orders work

After generating a family tree visualisation, you may:

  • Purchase a digital download (high-resolution image or PDF file)
  • Order a physical canvas print delivered to a shipping address

Orders are confirmed once payment is successfully processed.

7.2 Payment processing

All payments are processed by Stripe, Inc. You will be directed to Stripe’s secure payment interface. We do not store or process your payment card data; Stripe handles all card data under PCI DSS compliance. By making a purchase, you also agree to Stripe’s Terms of Service.

7.3 Accepted currencies

We accept orders in USD, GBP, EUR, and PLN (availability may depend on your location). Prices are displayed in your local currency where available. Currency conversion, if any, is handled by Stripe.

7.4 Pricing and taxes

Prices shown are inclusive of applicable VAT/sales tax for EU customers where required by law. For customers outside the EU, prices may be shown without tax; local import duties or taxes, if applicable, are the customer’s responsibility.

7.5 Order confirmation

After a successful payment, you will receive an order confirmation email. For digital orders, access to the download will be available immediately or within a short time after payment confirmation. For print orders, the confirmation initiates production.

7.6 Failed payments

If a payment fails, your order will not be confirmed. You may retry the payment or use a different payment method. We are not liable for order delays resulting from payment failures.


8. Digital Downloads

8.1 Delivery

After payment is confirmed, your digital file(s) will be available for download from your order history. You will also receive a download link by email.

8.2 Access period

Download links remain active for 12 months from the order date. After this period, files may no longer be available. We recommend saving your files locally after download.

8.3 Licence

When you purchase a digital download, we grant you a personal, non-exclusive, non-transferable licence to use the file for personal, non-commercial purposes, including:

  • Printing the tree for personal display
  • Sharing the file privately with family members
  • Storing the file for personal archival purposes

You may not:

  • Sell, sublicence, or distribute the file commercially
  • Claim the visual design as your own work
  • Remove any copyright notices embedded in the file

The genealogical data in the file originates from your GEDCOM upload and remains your own content.

8.4 File format

Digital downloads are provided in the formats selected at checkout (e.g. high-resolution JPEG, PDF). We do not guarantee compatibility with every software application.


9. Physical Print Orders

9.1 Production

Canvas prints are produced by our fulfilment partners (Posterjack for North American orders; Fotako for European orders) after your payment is confirmed. Production typically takes 3–5 business days after order confirmation, subject to the partner’s capacity.

9.2 Shipping

Shipping is handled by the fulfilment partner using the carrier selected at checkout (UPS, DHL, or national postal service). Estimated delivery times are shown at checkout and are indicative, not guaranteed.

9.3 Shipping address

You are responsible for providing a correct and complete shipping address. We cannot reroute orders once they have entered production. We are not liable for failed delivery resulting from an incorrect address provided by you.

9.4 Risk of loss

Risk of loss or damage to the print passes to you when the item is handed to the carrier. For EU/UK consumers, this provision applies only to commercial purchasers; consumer rights in your jurisdiction may provide additional protections.

9.5 Customs and duties

For deliveries outside the EU/UK, you may be liable for customs duties, import taxes, or other fees levied by your country’s customs authority. These are your responsibility and are not included in the price we charge.


10. Cancellations, Refunds and Returns

10.1 Digital downloads

Before download: You may cancel an undownloaded digital order within 14 days of purchase for a full refund, in accordance with your statutory rights (EU Directive 2011/83/EU; UK Consumer Contracts Regulations 2013).

Waiver of right to cancel for digital content: Before your download begins, you will be asked to confirm that (a) you request immediate delivery of the digital content and (b) you understand that by confirming, you lose your 14-day right of withdrawal once delivery has commenced. This confirmation is required by the EU Consumer Rights Directive (Art. 16(m)) and UK Consumer Contracts Regulations (Reg. 37). Without your explicit confirmation, the download will not begin. If you do not confirm, your 14-day cancellation right remains intact.

After download: Once the file has been downloaded, we generally cannot offer a refund except where the file is defective (corrupted, incorrect resolution, or substantially different from what was described). In such cases, contact support@clancharts.com within 14 days of download with a description of the issue. We will provide a corrected file or a full refund.

10.2 Physical print orders

Before production begins: Orders may be cancelled for a full refund if production has not yet started. Contact us at support@clancharts.com as soon as possible after placing the order.

After production begins: Once production has started, cancellation may not be possible. We will try to accommodate cancellation requests made promptly, but cannot guarantee this.

Defective or damaged items: If your canvas print arrives damaged or defective (including production errors, printing defects, or damage during transit), contact us at support@clancharts.com within 14 days of delivery with:

  • Your order number
  • A description of the defect
  • Photographs of the item and packaging

We will offer a free replacement or a full refund, at your choice. We may require you to return the defective item (at our cost) or to dispose of it and provide photographic evidence.

No refund in the following cases:

  • Incorrect shipping address provided by you
  • Colour variation due to monitor calibration (colours in print may differ from how images appear on screen — this is inherent to print production and not a defect)
  • Damage caused after delivery

10.3 EU/UK consumers — statutory rights

Nothing in these Terms limits your statutory rights as a consumer under applicable law, including the EU Consumer Rights Directive (2011/83/EU) or the UK Consumer Rights Act 2015. If there is any conflict between these Terms and your statutory rights, your statutory rights prevail.


11. Intellectual Property

11.1 ClanCharts’ intellectual property

ClanCharts owns or licences all intellectual property rights in:

  • The visual design styles, templates, and rendering algorithms that generate family tree visualisations
  • The ClanCharts brand, logo, and website design
  • The software and underlying technology powering the Service

You may not copy, reproduce, modify, distribute, or create derivative works of any of the above without our written permission.

11.2 Your content

You retain all rights in:

  • The genealogical data contained in your GEDCOM file
  • Any custom content you add (such as a personalised title or description)

By uploading a GEDCOM file, you grant ClanCharts a limited, non-exclusive, revocable licence to use the file solely to generate the family tree visualisation you have requested. We will not use your genealogical data for any other purpose.

11.3 Generated visualisation

The generated family tree image is a combination of ClanCharts’ visual design and your genealogical content. When you purchase a digital file or print, you receive the rights described in Section 8.3. ClanCharts retains the intellectual property in the visual style and template.


12. Sharing Your Family Tree

The Service may allow you to generate a link that lets others view your family tree without editing it. You control whether a share link is active.

12.2 Your responsibility for shared content

When you activate a share link, you are making the family tree — including the names and other information it contains — accessible to anyone with the link. You are solely responsible for ensuring that sharing the tree is appropriate given the personal data it may contain about living individuals.

ClanCharts provides the technical sharing feature but does not control, review, or endorse the content of shared trees. We are not liable for the consequences of your decision to share a tree containing personal data of others.

You may deactivate a share link at any time from your account settings. After deactivation, the link will no longer work.


13. Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.


14. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Defects in the Service will be corrected

This disclaimer does not affect your statutory rights as a consumer.


15. Limitation of Liability

To the maximum extent permitted by applicable law, ClanCharts and its directors, employees, and suppliers will not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, goodwill, or business
  • Damages arising from your use of or inability to use the Service
  • Any third-party claims arising from data in a GEDCOM file you uploaded

Our aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the greater of: (a) the amount you paid to ClanCharts in the 12 months preceding the claim, or (b) €50 / £50 / $50 (in the currency applicable to your order).

This limitation of liability does not apply to:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be limited by law

For EU and UK consumers, the above limitations apply only to the extent permitted by mandatory consumer protection law. Your statutory rights are not affected.


16. Indemnification

You agree to indemnify, defend, and hold harmless ClanCharts, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service in violation of these Terms
  • Data contained in any GEDCOM file you uploaded, including any claim by a third party (such as a living individual named in the file) that their personal data was processed without a lawful basis
  • Your breach of any representation or warranty in these Terms
  • Your violation of any applicable law

17. Termination

17.1 Termination by you

You may stop using the Service at any time and delete your account via account settings or by contacting support@clancharts.com.

17.2 Termination by ClanCharts

We may suspend or terminate your access to the Service at any time, with or without notice, if:

  • You violate these Terms
  • We are required to do so by law
  • We reasonably believe continued access poses a risk to other users or to the Service

17.3 Effect of termination

Upon termination:

  • Your right to use the Service ceases immediately
  • Your uploaded files will be deleted within 30 days (subject to any applicable legal retention obligations)
  • Orders already in production will be fulfilled; refunds for incomplete orders will be issued where appropriate
  • Sections of these Terms that by their nature survive termination (including Sections 11, 15, 16, 18) will remain in force

18. Governing Law and Dispute Resolution

18.1 Governing law

These Terms are governed by the laws of Poland and the applicable regulations of the European Union, without regard to conflict of law principles.

18.2 For EU consumers

If you are a consumer residing in the EU, you benefit from any mandatory consumer protection provisions of the law of your country of residence. Those provisions will apply alongside Polish law. Furthermore, as a consumer, you retain the right to bring proceedings before the courts of the EU member state in which you habitually reside, regardless of the governing law clause in these Terms. A governing law clause does not deprive you of the protection of mandatory provisions of your country’s law.

The European Commission provides an Online Dispute Resolution (ODR) platform for consumers in the EU: https://ec.europa.eu/consumers/odr. We are not required to participate in alternative dispute resolution, but we will make reasonable efforts to resolve disputes informally.

18.3 For UK consumers

If you are a consumer residing in the UK, mandatory consumer protection provisions of UK law apply. You retain the right to bring proceedings before UK courts regardless of any governing law or jurisdiction clause in these Terms.

18.4 For non-EU, non-UK users

For users outside the EU and UK, any disputes arising out of these Terms shall be subject to the jurisdiction of the courts of Poland. Nothing prevents you from seeking relief in a court of your own jurisdiction if you are entitled to do so under local law.


19. Consumer Rights — EU and UK

Nothing in these Terms is intended to limit or exclude:

  • EU: Rights under the Consumer Rights Directive (2011/83/EU), the Unfair Terms in Consumer Contracts Directive (93/13/EEC), or applicable national consumer law
  • UK: Rights under the Consumer Rights Act 2015, Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or the Unfair Contract Terms Act 1977

If any provision of these Terms conflicts with mandatory consumer protection law in your jurisdiction, that law prevails over our Terms for consumer transactions.


20. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Notify registered users by email at least 14 days before the changes take effect
  • Display a prominent notice on the website

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service before the effective date.
